Versioning notice
These are the Terms of Service v1.0, published 2026-06-22. We will date and version any subsequent revision.
For the avoidance of doubt: the binding agreement for any paid MonkSuite deployment is the Master Services Agreement (MSA) and Data Processing Agreement (DPA) signed between MonkSuite and the customer. These Terms govern use of the MonkSuite websites and any free-trial, demo, or evaluation access we may grant; they do not modify a signed MSA.
1. About these Terms
These Terms of Service (the "Terms") apply to your access to and use of the MonkSuite websites and products — including ScrapeMonk, TidyMonk, MatchMonk, PriceMonk, and Wistery Admin — and any related online services we provide without a separate signed agreement (collectively, the "Service"). By accessing the Service, you accept these Terms. If you do not accept these Terms, do not use the Service.
2. Who we are
MonkSuite is a family of products operated by TopMonks s.r.o. Full legal entity details and signing authority are provided on order forms and the MSA. For correspondence on these Terms, contact legal@monksuite.io.
3. Eligibility
You may use the Service if you are at least 18 years old and have the legal capacity to enter into a binding agreement. The Service is intended for use by businesses; consumer use is not contemplated.
4. Account and pilot access
If we grant you account access for an evaluation, pilot, or demo, you are responsible for safeguarding your credentials and for any activity under your account. Pilot or evaluation access may be revoked at any time at our discretion, on reasonable notice where practical.
5. Acceptable use
You agree not to:
- attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
- reverse engineer, decompile, or attempt to derive source code from the Service except where permitted by applicable law;
- use the Service to infringe third-party rights, transmit unlawful content, or transmit malware;
- use data-collection products to systematically collect special categories of personal data (GDPR Art. 9) or data of children, without a valid legal basis and all necessary consents;
- abuse, harass, or threaten MonkSuite personnel or other users of the Service.
6. Intellectual property
The websites, the Service, and all underlying software, documentation, and trademarks are the property of MonkSuite and its licensors. You retain ownership of any data you upload or collect through the Service. You grant MonkSuite a limited, non-exclusive licence to process your data solely to provide the Service. Detailed data-processing terms live in the DPA for paid deployments.
7. Privacy and data handling
Our handling of personal data is described in our Privacy Policy and, for paid deployments, in the DPA. We process personal data within the EU by default. We do not sell personal data.
8. Warranties and disclaimers
The websites and any free or evaluation Service are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable law. Warranties applicable to paid deployments are stated in the MSA.
9. Limitation of liability
To the maximum extent permitted by applicable law, MonkSuite will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the websites or any free or evaluation Service. Liability for paid deployments is governed by the MSA.
10. Termination
We may suspend or terminate your access to the websites or the Service at any time if we reasonably believe you are in breach of these Terms. You may stop using the Service at any time. Termination of paid deployments is governed by the MSA.
11. Changes to these Terms
We may update these Terms from time to time. The version date below records the publication date. Material changes will be communicated in writing where you have an account.
12. Governing law
These Terms are governed by the laws of the European Union member state in which MonkSuite's contracting entity is incorporated. Disputes will be resolved by the competent courts of that jurisdiction, without prejudice to any mandatory consumer-protection law that applies to you.
